Terms and Conditions of Sale

Preamble
The site is entirely owned by SASU ultimate, as are all related rights. Any reproduction, in whole or in part, is systematically subject to the owners' authorization. However, hypertext links to the site are permitted without specific requests.

1. Acceptance of terms
The customer acknowledges having read, at the time of placing the order, the specific conditions of sale stated on this screen and expressly declares to accept them without reservation. These general conditions of sale govern the contractual relationship between ultimate and its customer, both parties accepting them without reservation. These general conditions of sale shall prevail over all other conditions appearing in any other document, except for prior, express and written derogation.

2. Products
The photographs illustrating the products are not part of the contract. If errors have been introduced, in no case can ultimate's liability be engaged. The majority of products offered to its customers by ultimate are available in our warehouse.

3. Order
Automatic registration systems are considered as proof of the nature, content and date of the order. ultimate confirms acceptance of its order to the customer at the email address provided by the customer. The sale will only be concluded upon confirmation of the order. ultimate reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order. The information stated by the buyer when placing the order is binding on the latter: in the event of an error in the recipient's contact details, the seller cannot be held responsible for the impossibility of delivering the product.

4. Delivery
After order confirmation, ultimate undertakes to deliver to its carrier all references ordered by the buyer within a maximum of 48 working hours. This carrier undertakes by contract with ultimate to deliver the order to the buyer's address provided by ultimate.
In the case of a cash-on-delivery transport system, the customer undertakes to pay the carrier or his representative the full amount indicated at the time of order confirmation. Furthermore, for deliveries outside mainland France, the customer undertakes to pay all taxes due on the import of products, customs duties, value-added tax, and all other taxes due under the laws of the country of receipt of the order. All orders placed with ultimate are intended for the personal use of customers, customers or recipients of products are prohibited from any partial or total resale of the products. ultimate disclaims all legal liability if the taxes were not paid by the customer. Delivery will be made by La Poste by Colissimo suivi or Chronopost depending on the customer's choice of transport in mainland France. Delivery is made within the time slot agreed with the customer by direct delivery of the product to the announced recipient, or in case of absence, to another person authorized by the customer. Any delays do not entitle the buyer to claim damages. Deliveries to EEC countries are made by La Poste by Colissimo suivi Europe or by Chronopost depending on the customer's choice, for deliveries outside the EEC deliveries are made by international postal services or Chronopost depending on the customer's choice. In the case of a technical product, the customer will be particularly careful to check the proper functioning of the delivered device and to read the instruction manual provided. In the event of apparent defects, the buyer benefits from the right of return under the conditions provided in this document. Cases of force majeure releasing the seller from his obligation to deliver include war, riot, fire, strikes, accidents and the impossibility of being supplied. Goods always travel at the recipient's risk. Always check your package upon arrival. You have 48 hours to make any reservations with the carrier in case of missing items or damage. For reasons of availability, an order may be delivered to the customer in several installments. The customer then only pays for one delivery. If the customer wishes 2 delivery locations, he places 2 orders, with the associated delivery costs.

5. Withdrawal, return

!!! Only items returned in their entirety, with their label, in their complete original packaging, and in perfect resalable condition will be accepted. Any item that has been damaged in any way, worn, or soiled, animal hair... and whose condition does not allow direct resale, will neither be exchanged nor refunded, and will be returned to the customer.

In the event of exercising the right of withdrawal, ultimate is obliged to reimburse the sums paid by the customer, free of charge, with the exception of shipping costs. The refund is due within a maximum of 15 days.

6. Price
The price is expressed in euros. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the final price, expressed all taxes included and including VAT for France and EEC countries. This price includes the price of the products, handling, packaging and storage costs of the products, transport and commissioning costs.

7. Payment
The price invoiced to the customer is the price indicated on the order confirmation sent by ULTIMATE. The price of the products is payable in cash on the day of the effective order. Payment is made by bank card bearing the CB logo. Online Cyberplus Paiement allows you to pay via a Banque Populaire banking server in a secure environment. Your bank card number is therefore directed to the bank's servers, your payment is made directly to a bank in a secure environment without passing through the store's server, a guarantee all the more important as your numbers are known only to our banking partner (Banque Populaire). The order validated by the customer will only be considered effective when the relevant bank payment centers have given their agreement. In case of refusal by said centers, the order will be automatically canceled and the customer notified by email. Furthermore, ULTIMATE reserves the right to refuse any order from a customer with whom a dispute exists.

8. Disputes
This contract is subject to French law. ULTIMATE cannot be held responsible for damages of any kind, whether material, immaterial or bodily, which could result from a malfunction or misuse of the marketed products. The same applies to any modifications to the products resulting from the manufacturers. ULTIMATE's liability will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions that may have persisted despite all precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, particularly with the help of: a professional association in the sector, a consumer association or any other advisor of his choice. It is recalled that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is recalled that, as a general rule and subject to the appreciation of the Courts, compliance with the provisions of this contract relating to the contractual guarantee implies that the buyer honors his financial commitments towards the seller. Claims or disputes will always be received with attentive goodwill, good faith always being presumed in anyone who takes the trouble to explain their situation. In case of dispute, the customer will first contact the company to obtain an amicable solution. Failing this, the Commercial Court of Digne les Bains has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

9. Warranty
In all cases, ULTIMATE cannot be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt, ULTIMATE's liability is systematically limited to the value of the product in question, its value at its date of sale and this without possibility of recourse against the brand or the producing company of the product. In any event, the customer benefits from the legal guarantee against eviction and hidden defects (Art. 1625 et seq. of the Civil Code). Provided that the buyer proves the hidden defect, the seller must legally remedy all its consequences (Art. 1641 et seq. of the Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (Art. 1648 of the Civil Code).

10. Legal information
The provision of personal information collected for the purpose of distance selling is mandatory, this information being essential for the processing and delivery of orders, the establishment of invoices and warranty contracts. Failure to provide information will result in the non-validation of the order. In accordance with the "Data Protection Act", the processing of personal information relating to customers has been declared to the National Commission for Data Protection and Liberties (CNIL). The customer has (article 34 of the law of January 6, 1978) a right to access, modify, rectify and delete data concerning him, which he can exercise with ULTIMATE.
Furthermore, ULTIMATE undertakes not to communicate, free of charge or with consideration, the contact details of its customers to a third party.
